Although each case is unique, in most disputes, there will be several options for resolution, including negotiation and mediation, in addition to arbitration or litigation.  Our attorneys will work with our clients to review and explain available options to them and to develop a practical, cost-effective action plan that is customized to our client’s needs and the unique facts of each case.

Lawsuits and arbitration proceedings are often expensive and disruptive of business operations.  Fortunately, there are usually opportunities during the course of such proceedings to resolve the dispute before incurring the full expense and inconvenience of a trial or arbitration hearing.  When the parties’ own negotiations reach an impasse, non-binding mediation of a dispute can be a very effective tool for resolving disputes.   In non-binding mediation, an impartial third party (often an attorney of many years’ experience or an ex-judge, and in all events, certified or qualified to perform mediation) is paid to facilitate settlement negotiations between the parties.

Although a negotiated or mediated settlement of a business dispute is often the wisest course to take, there are always exceptions.  On occasion, litigating a case to judgment is the best way to resolve a dispute, and the attorneys at The Dushkin Law Firm can provide strong advocacy for our clients in litigation or arbitration.
